When officers arrived on scene the defendant was noticed to have an odor of alcoholic beverage, bloodshot watery eyes, slurred speech and was unsteady on her feet. The defendant was asked to do roadside sobriety exercises and performed poorly. The defendant admitted she was at a bar and was drinking. She submitted to the breath test and came in over the legal limit at .127/.130 g/210 L. The firm filed motions to suppress statements, the roadside exercises and the breath test. All motions were granted and the state dropped all DUI charges.
