According to the police, the Defendant was observed driving 82 mph in a 45 mph zone. When the pulled him over, they noticed a strong odor of alcohol on his breath, his speech was slurred and his eyes were bloodshot and glassy. The Defendant stumbled as he walked away from his car. The officer asked him to perform roadside exercises. They completed one exercise (horizontal gaze nystagmus) and the Defendant’s performance was very poor.
