Our client was pulled over for doing an illegal u-turn at 2 in the morning. The officers did not notice any other bad driving and our client pulled over and conducted himself fine. When officers approached his vehicle they smelled the strong odor of alcohol, noted he had bloodshot, glassy eyes, slurred speech, and was uneasy on his feet. The video of his field sobriety exercises showed that he did not have slurred speech and was able to perform he exercises relatively well. Our client provided two breath samples,the first being .163 over twice the legal limit. Our firm prepared the case for trial. After pointing out some crucial flaws in the State's case and after providing them with some significant mitigation the State offered our client a Reckless Driving which will save his career as a Commercial Driver.
