On December 18, 2018, a call for a reckless driver was received by 911. The call complained the vehicle was unable to maintain a single lane, and crossed over center line. The caller followed the vehicle until it stopped at the 41 Smoke Shop in Ruskin. Hillsborough County Deputies arrived on scene and saw a vehicle matching the caller's description parked in the parking lot. The Deputies made contact with the driver and asked him to step out of the vehicle. The Defendant left the vehicle running when he got out of the vehicle. The Defendant had difficulty maintaining his balance. The Defendant had constricted pupils and watery eyes. The Defendant performed the field sobriety exercises and impairment was observed by the Deputies. The Defendant provided a breath sample which resulted in 0.000 breath alcohol level. Due to the level of impairment and the breath results negative for alcohol, the Deputy requested a urine sample. Post Miranda, the Defendant admitted to taking Vicodin earlier in the day.
Results: The firm presented evidence of the Defendant's past injuries and prescribed medications to the State Attorney's Office. After review of all of the evidence, the State dismissed the DUI charge
