The Client's boat was stopped for speeding in a slow area. The Officer immediately believed that the client had consumed too much alcohol. The Officer conducted a BUI investigation and then arrested the Client for BUI. Once at the jail the Client refused to give a breath sample. The Firm investigated the case and determined that the State simply did not have enough evidence to prove the Client was impaired while operating a boat. The State agreed and dismissed the BUI, but kept the refusal to submit to a breath sample charge. The Firm argued that the same lack of evidence would be a problem regarding the refusal charge against the Client. The State finally agreed and later dismissed the refusal to submit to a breath test charge as well.
