The Client was stopped because he was driving down a sidewalk with his vehicle that was beside the ocean. Law enforcement stopped him because they were concerned he would drive into the ocean by mistake. Once stopped they believed that the Client was under the influence of alcohol to the extent that his normal faculties were impaired. The Officers did not ask him to do field sobriety exercises, but instead ordered him to do the exercises, in contrast to the law. The Firm pointed this issue out to the State, who were initially reluctant to the dismiss the DUI because of the Client's prior DUI history, but eventually agreed to dismiss the DUI charge.
