The Client was stopped for speeding. Once stopped the Officer believed that the Client was impaired. The Client spoke Spanish and one of the Officers on scene also spoke Spanish and attempted to translate for him. A DUI investigation was conducted and the Client was subsequently arrested based upon said investigation. Once the Client was at the jail he gave a breath sample over a .08, but was having trouble understanding what the Officer was saying because of the language barrier. The Firm argued that because the Client had a clean record, was cooperative, and there were issues in the Officer's investigation because of his language barrier, that the State should dismiss the DUI. The State agreed and dismissed the DUI.
