The Client was stopped for driving 16mph over the speed limit. Once stopped the Officer observed an odor of alcohol and the Client indicated that she had previously consumed two drinks. The Officer conducted a DUI investigation where he had the Client perform field sobriety exercises. The Client performed poorly on these exercises and was arrested. While at the jail the Client gave a breath sample over the legal limit. Once the Firm was retained an investigation of the case was conducted. In the Firm's investigation it was determined that the Client had an absolutely clean record, was extremely cooperative with law enforcement, and did not have a bad driving pattern or a high breath sample. The Firm pointed these issues out to the State and the DUI charge
was subsequently dismissed.
