The Client was stopped for running a stop sign. Once stopped the Officer noticed signs of impairment and had the Client submit to sobriety tasks. The Client did not perform well on the sobriety tasks and was then arrested for DUI. Once arrested he gave a breath sample that was four times the legal limit. In addition, the Firm then discovered that this was his second DUI in five years. The Firm conducted a formal hearing to try and save his driver's license. During the hearing the Firm was able to get the officer who made the stop of his vehicle to admit she had no memory of either the stop of the vehicle or administering the breath test. As a result the State agreed to drop the DUI charge and the Client was able to avoid mandatory jail and a five year license suspension.
