The Client was stopped for speeding. Once stopped the Officer suspected the Client was impaired by alcohol and asked him to submit to some sobriety exercises. The Client complied but did poorly on the exercises. The Client was then arrested for DUI and transported to the Breath Alcohol Testing facility where he refused to give a breath sample. The Firm investigated the case and determined that the stop of the Defendant's vehicle was improper because the Officer based his observation of speeding off of a very brief pace clock. Before the Firm could even file a motion to address this issue, the State agreed to dismiss the case.
