Defendant was driving in a casino parking lot nearly running into other vehicles and pedestrians. There were eye witnesses who corroborated this pattern of driving. Officers described the defendant as being very intoxicated, having slurred speech and the odor of alcohol on his breath. He was also standing with a red cup containgin alcohol in the presence of the officer. The defendant performed poorly on the roadside exercises. The defendant refused the breath test. Case dismissed before filing.
