The defendant was seen driving at a high rate of speed by two officers running radar in the City of Margate, FL. The officers made contact with the defendant and noticed that he had an odor of an alcoholic beverage and bloodshot watery eyes. The defendant also admitted to consuming 4-5 beers before driving. The defendant performed poorly on roadside sobriety exercises and refused a breath test. The firm filed a Motion to Dismiss based on Destruction of Videotape Evidence.
