A citizen called to report what they believed to be a reckless driver in Monroe County, FL. An officer later stopped our client based on that call. When they stopped our client, they alleged that our client had indicators of impairment, to include bloodshot eyes, odor of alcohol, and slurred speech. Our client completed field sobriety exercises as requested by officers and was arrested for DUI. Officers said our client could not count properly – with no regard for whether he sufficiently understood English. Our client also provided 2 breath samples of .158 and .154. We immediately began investigating the case and reviewing all of the evidence. We discussed the issue of the reckless driver call and the associated caselaw surrounding that issue. Once we reviewed everything, the State agreed to dismiss the DUI charge.
